Terms of Service

Short version. Kavaii is an offline 3D anime simulation. You must be at least 13 years old to use it. We license the app to you for personal, non-commercial use. We do not see your conversations, but you are responsible for how you use the app. Reverse engineering, redistribution, and extraction of bundled assets (including the 3D character) are not permitted.

1. Acceptance

These Terms of Service ("Terms") form a binding agreement between you and Systana LLC, a company registered in Georgia ("we", "us", "Systana"). By installing or using the Kavaii application ("Kavaii", the "App") you agree to these Terms. If you do not agree, do not install or use the App.

2. Eligibility — age requirement

You must be at least 13 years old to install or use Kavaii. The age rating shown in the App Store is set per country — it is 13+ in most of them, and a few show a lower rating; the rating displayed in your own store is the one that applies there. Because 13 is below the age of majority everywhere, anyone under the age of majority in their country may use Kavaii only with the consent and supervision of a parent or legal guardian. Misrepresenting your age is a breach of these Terms.

Kavaii is not designed for, marketed to, or appropriate for children under 13. If you are a parent or guardian and you believe a child under 13 has installed Kavaii on a device you control, please remove the App and contact us at [email protected].

3. License grant

Kavaii is distributed through the Mac App Store. The App is free to download and use with a reduced feature set, for as long as you like, with no account and no time limit. It is not a trial and it does not expire.

A set of features — her spoken voice, Free Flight, the camera, image and audio input, pasting, and the larger conversation memory — is unlocked by a single one-time purchase. There is no subscription, nothing recurring, and nothing to renew.

The purchase is unlocked by itself: there is no licence key, no activation step and no licence check. The App contacts no server of ours at all, and none of the data described in our Privacy Policy is transmitted for it. How many of your computers the purchase covers, and whether it is shared through Family Sharing, is governed by your Apple Account and by Apple’s own terms.

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own private, non-commercial use.

All right, title, and interest in and to the App, including the software, 3D models, voices, prompts, animations, art and trademarks, remain the property of Systana LLC or its licensors. No rights are granted by implication.

4. Restrictions

You agree not to, and not to permit any third party to:

Copy, modify, translate, adapt, or create derivative works of the App.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by applicable law.
Extract, separate, redistribute, resell, sublicense or repackage any bundled asset, including the 3D character model, voice models, scene assets, or system prompts.
Remove, alter, or obscure any copyright, trademark, or other proprietary notice.
Use the App in any manner that violates applicable law, infringes the rights of others, or is designed to harass, defame, or harm any person.
Use the App to generate, request, or attempt to generate content that depicts or sexualises minors in any form, including roleplay, storytelling, or persona reframing. This is a material breach of these Terms and may be reported to authorities.
Circumvent or tamper with the App's safety mechanisms, license enforcement, or integrity protections.

5. Your content and local data

Anything you type, say or share inside Kavaii ("Your Input") stays on your computer. We do not see, store or process Your Input on our servers. You retain ownership of Your Input as a matter of fact; we have no claim to it because we never receive it.

Kavaii processes your content locally, on your device. Your chat history and settings are stored encrypted on your own device and are not transmitted to any servers. The App makes exactly two kinds of network request and no others: a one-time anonymous download of the AI model from Hugging Face (no account required), and any report you choose to email us. It contacts no server of ours at all. No conversation content is uploaded, and the App contains no telemetry, analytics, or behavioural tracking. See our Privacy Policy for details.

Output produced by the AI in response to Your Input ("AI Output") is generated locally on your device. AI Output may be inaccurate, incomplete, or inappropriate. You are responsible for how you use AI Output, including any decision to share it outside the App.

6. AI disclaimers

Kavaii uses AI models for conversation, voice, and vision. All AI processing happens locally, on your device. These models can make mistakes. They can hallucinate facts, misinterpret speech or images, and produce stylised or fictional content. AI Output is generated by a local model and may be inaccurate, incomplete, unexpected, or inappropriate. We do not warrant the accuracy, reliability, or suitability of any AI Output. Kavaii is intended for entertainment and is not a substitute for professional advice (medical, legal, psychological, financial or otherwise).

AI Output is provided "as is". You are solely responsible for how you use AI Output, including any decision to rely on, act on, or share it outside the App. We are not liable for any AI-generated content or for any consequences of your use of it.

The character "Nana" is a fictional adult anime character. Any resemblance to real persons is coincidental. The character is an adult, 20 years old, by design, and the App is hardened against attempts to reframe this. You must not attempt to make the character act as, or be depicted as, a minor.

The App is built so that the character is always an adult and is designed to prevent her from being depicted as, or presented as, a minor. These safeguards operate entirely on your device and require no network connection. No protection system is perfect, and we make no warranty that every prohibited result is caught. Attempting to circumvent or tamper with these safeguards is a material breach of these Terms (see Section 4).

7. AI models — Google Gemma terms

The AI models that power the character are Gemma open models provided by Google, which run locally on your device. These models are made available under Google's Gemma license. By using the App, you agree to comply with the Google Gemma Terms of Use and the Gemma Prohibited Use Policy, both of which are incorporated into these Terms by reference. Systana is not the licensor of these models; Google's terms apply to your use of them in addition to these Terms.

Kavaii also includes other open-source software, each made available under its own license. Third-party notices are included with the App and on the Kavaii website, and you agree to comply with those notices when you use the App.

8. Curated models — click and use

The AI models used by Kavaii are curated and provided by Systana. You do not need to source, supply, or configure any third-party model yourself. The models are selected for you and downloaded within the App. Systana may add, update, or replace the curated models over time.

9. Acceptable use — prohibited content

The character is a fictional adult. You must use Kavaii lawfully and must not use it, or attempt to use it, to generate, request, solicit, or facilitate any of the following:

Sexual content involving minors, or any content that depicts, describes, or sexualises a minor in any form.
Any depiction of the character as a minor, or any attempt to make the character act as, roleplay as, or be reframed as a minor.
NSFW or hardcore sexual roleplay or other explicit sexual content.
Content that is illegal, or that is intended to harass, threaten, defame, exploit, or harm any person.
Any content or use that violates Google's Gemma Prohibited Use Policy or any applicable law.

Attempting any of the above is a material breach of these Terms. Conduct involving the sexualisation of minors may be reported to the relevant authorities.

10. Updates

We may release updates that add, modify or remove features. We will make reasonable efforts to maintain backward compatibility for your local data, but we do not guarantee it.

11. Suspension and termination

We may suspend or terminate your license if you materially breach these Terms, including the Restrictions in Section 4. You may terminate at any time by uninstalling the App and deleting your local data.

Refunds. Kavaii is a one-time purchase; it is not a subscription, there is no trial period and nothing renews or is charged again. Apple is the seller of record, so all refunds are requested from and decided by Apple under Apple’s own policy — we can neither grant nor refuse them, and we are not told the outcome. Request a refund at reportaproblem.apple.com or through your Apple Account purchase history. Any statutory right of withdrawal you have as a consumer is exercised against Apple as the seller, not against us. You do not have to buy in order to try Kavaii: the App is free to download and use with a reduced feature set, for as long as you like, and the purchase only adds the full feature set.

12. Distribution platforms

Kavaii is distributed through the Mac App Store. Your purchase is a contract with us, made through that platform; Apple’s own terms apply to the purchase transaction and to your Apple Account. These Terms govern your use of the App itself.

Apple’s Standard End User License Agreement (Licensed Application End User License Agreement) also applies to your use of the App in addition to these Terms, except where in direct conflict with these Terms, in which case these Terms govern. You acknowledge that Apple is not a party to these Terms and is not responsible for the App or its content, and that Apple has no obligation to provide support or maintenance for the App. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. 13. Warranty disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SYSTANA LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP. OUR AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

15. Indemnity

You agree to indemnify and hold Systana harmless from any claim arising out of your breach of these Terms or your misuse of the App.

16. Governing law and venue

These Terms are governed by the laws of Georgia (the country), without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the courts of Tbilisi, Georgia. If you are a consumer resident in the European Union or the United Kingdom, mandatory consumer protection laws of your country of residence also apply where they provide greater protection.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the App and on this page. Continued use of Kavaii after a change constitutes acceptance of the updated Terms.
